PURCHASE TERMS & CONDITIONS
These terms apply to all in-store and online purchases of card products including but not limited to Trading Card Games (TCG), booster packs, boxes, sets, singles, and related merchandise sold by Devitt Collectables. Provisions concerning physical inspection in store or in-store conduct apply where relevant to an in-store purchase or visit. By purchasing any product, you acknowledge that you have read, understood, and agreed to these terms.
1.No Change-of-Mind Returns or Exchanges
Subject to your rights under the Australian Consumer Law (ACL), we do not offer refunds, exchanges, or store credit for:
●change of mind;
●dissatisfaction with random outcomes;
●duplicate cards or unwanted pulls;
●perceived value or collectability;
●minor imperfections described in clause 3.
2.Please Inspect Before Purchase
We strongly encourage all customers to inspect products carefully before completing a purchase. Our staff are available to assist you with any queries about a product’s condition prior to purchase.
●For sealed products (booster packs, boxes, cases), you may examine the outer packaging for visible damage but cannot open them in-store prior to your purchase unless explicitly permitted by staff.
●Once the purchase is complete, you accept the product in its current condition as inspected, only subject always to your rights under the ACL.
3.Randomised Products and No Guarantee of Contents
●Trading cards and TCG products are inherently random. Manufacturer-inserted hit rates, chase cards, rarities, or specific pulls are averages or probabilities only and are not guaranteed for any individual pack, box, or case. Opening card products is entirely at your own risk.
●We do not offer refunds, exchanges, or compensation if your product does not contain specific cards, hits, or meets advertised average insertion rates. This is consistent with industry practice for sealed collectables.
4.Product Condition & Packaging
●For singles and graded cards, minor cosmetic imperfections inherent to the manufacturing and distribution process are considered normal and do not constitute a fault or defect under the ACL. We do not accept returns for subjective grading disputes or personal expectations of condition. Normal imperfections may include:
oMinor scuffs, scratches, or surface wear on outer packaging (box, booster wrapper, tin, binder).
oSlight dents, indentations, or creasing on packaging due to shipping and handling.
oMinor print defects, slight colour variation, or miscut/misalignment on individual cards as produced by the manufacturer.
oMinor foil or wrapper texture variations.
oSlight warping or bending of cards within normal manufacturing tolerances.
●For sealed products, to the extent permitted by law, we are not responsible for manufacturing variations, print quality issues inside sealed packs, or condition of cards once opened.
●If you have concerns about a specific product’s condition, please ask a staff member for assistance before completing your purchase.
5.Authenticity
We guarantee that all products sold are authentic and untampered with to the best of our knowledge. If a product is proven to be counterfeit or tampered (not due to post-purchase handling), we will address it in accordance with ACL. Proof of purchase and clear evidence are required.
6.Faulty, Damaged, or Misdescribed Products
Notwithstanding the above, if a product you have purchased is genuinely defective or faulty, not as described, or unsafe, you may have rights under the ACL. Examples of situations that may give rise to an ACL remedy include:
●The factory seal was already broken at the time of purchase and this was not disclosed to you.
●The product contains visibly fewer items than its advertised or stated contents due to a manufacturing error.
●The product is materially different from how it was described or represented to you.
●The product presents a genuine safety risk.
If you believe your product is affected, please contact us as soon as practicable with valid proof of purchase. We will assess the product and, where the ACL applies, provide an appropriate remedy.
We encourage consumers to open the purchased product in our store in front of our staff after your purchase.
7.Return & Claim Process
Customers seeking a remedy under clause 6 must provide proof of purchase and return the product in its original condition, including all contents and packaging.
For sealed or randomised products, customers are strongly encouraged to provide a clear, continuous unboxing video showing the sealed condition and contents. Failure to provide sufficient evidence may affect our ability to assess the claim.
We may refuse a return (to the extent permitted by law) where the product is incomplete, altered, damaged after purchase, or not in a condition suitable for resale.
8.Pricing & Availability
All prices are displayed in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax) where applicable. Prices are subject to change without prior notice. Stock is limited and availability cannot be guaranteed. We reserve the right to limit quantities purchased per customer.
9.Store Credit & Goodwill Gestures
Where we choose, at our sole discretion, to offer store credit or other goodwill gesture (such as a partial refund or exchange) in circumstances not required by law, any such offer is non-refundable, non-transferable, and cannot be exchanged for cash. Acceptance of a goodwill gesture does not waive your rights under the ACL.
10.In-Store Conduct
We ask all customers to treat staff and fellow customers with courtesy and respect. We reserve the right to refuse service to, or ask to leave, any individual who:
•Is abusive, threatening, or harassing toward staff or other customers.
•Is reasonably suspected of shoplifting, damaging stock, or tampering with sealed products.
•Engages in behaviour that disrupts the normal operation of the store.

11.Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms & Conditions limits, excludes, or modifies any right or remedy available to you under the ACL. Where any term is inconsistent with the ACL, the ACL prevails.
12.Governing Law
These Terms are governed by the laws of New South Wales, Australia (or the relevant state/territory in which the purchase is made). Nothing in these Terms is intended to, nor shall it be interpreted to, exclude, restrict, or modify any consumer guarantee or right that cannot lawfully be excluded, restricted, or modified under the ACL or any other applicable Australian law.

13.Lower Prices Elsewhere and Sealed Trading Card Products
This clause applies to both in-store and online purchases. Subject to your rights under the Australian Consumer Law, finding the same or a similar product at a lower price from another retailer after completing a purchase does not entitle you to a return, refund, exchange, store credit, or adjustment of the price paid. We do not offer price matching or retrospective price adjustments unless Devitt Collectables has expressly agreed otherwise.

This policy applies even if the product remains sealed and unopened. Trading card boxes and other sealed card products contain randomised contents. Once such a product has left our care, we cannot independently verify the integrity of a returned product or whether its contents have been altered. We therefore do not accept returns of these products solely for change of mind or because a lower price is found elsewhere.

Nothing in this clause limits, excludes, or modifies any right or remedy available under the Australian Consumer Law where a product is faulty, damaged, unsafe, or not as described.
